The target article does not address the neural mediation of complex social behavior. I review evidence that such mediation may be compatible with proposed Bayesian information-processing principles. Notably, however, such mediation occurs subcortically as well as cortically, concerns reward uncertainty and information uncertainty, and impacts culture via group-level payoff structures that define individualism and collectivism.

DNA double‐strand breaks (DSBs) are extremely hazardous lesions for all DNA‐bearing organisms and the mechanisms of DSB repair are highly conserved. In the eukaryotic mitotic cell cycle, DSBs are often present following DNA replication while, in meiosis, hundreds of DSBs are generated as a prelude to the reshuffling of the maternally and paternally derived genomes. In both cases, the DSBs are repaired by a process called homologous recombinational repair (HRR), which utilises an intact DNA molecule as the repair template. (...) Mitotic and meiotic HRR are managed by ‘checkpoints’ that inhibit cell division until DSB repair is complete. Here we attempt to summarise the substantial recent progress in understanding the checkpoint management of HRR in mitosis (focussing mainly on mammals) and then go on to use this information as a framework for understanding the presumed checkpoint management of HRR in mammalian meiosis. The apolipoprotein E gene plays an important role in the pathogenesis of Alzheimer's disease , and amyloid plaque comprised mostly of the amyloid-beta peptide ) is one of the major hallmarks of AD. However, the relationship between these two important molecules is poorly understood. We examined how A treatment affects APOE expression in cultured cells and tested the role of the transcription factor NF-B in APOE gene regulation. To delineate NF-B's role, we have characterized a 1098 nucleotide segment containing the (...) 5'-flanking region of the human APOE gene . Sequence analysis of this region suggests the presence of two potential NF-B elements. To demonstrate promoter activity, the region was cloned upstream of a promoterless luciferase gene. This segment was able to drive expression of luciferase in transient transfections of human fetal glial cells. Promoter activity was stimulated twofold by A treatment. Pretreatment with double-stranded DNA decoy oligonucleotides against NF-B reduced A stimulation. Deletion and mutagenetic analyses demonstrated that the distal NF-B element was functional and showed a strong DNA-protein complex band in gel shift analysis, similar to that from control NF-B consensus element. An anti-inflammatory and anti-NF-B drug, sodium salicylate, significantly blocked A-induced APOE promoter function. Our data provide evidence that upregulation of APOE by A in astroglial cells is mediated by an NF-B-element present in the 5'-flanking region of the APOE gene. (shrink)

In many countries publications in Web of Knowledge journals are dominant in the evaluation of educational research. For various purposes comparisons are made between the output of philosophers of education in these journals and the publications of their colleagues in educational research generally, sometimes also including psychologists and/or social scientists. Taking its starting-point from Hayden’s article in this journal , this paper discusses the situation of educational research in three countries: The Netherlands, South Africa and Norway. In this paper an (...) alternative for comparing research output is offered by invoking comparisons with colleagues at the international level from within the same sub-discipline. It is argued that if one would do so a different picture would emerge, even if one were to limit oneself to particular kinds of publications. The case is then made that if comparisons are regarded as a necessary part of the evaluation of an individual scholar , it would be more fair to use a proxy system which is sub-discipline specific, or minimally contains some kind of correction factor in relation to the over-all quality assessment device. Debates about the relevance or irrelevance of philosophy of education in the context of educational sciences are now obscured, even poisoned by focusing almost exclusively on a particular kind of publication output. As the ‘reward’ system that is developed accordingly is possibly the most important driver of educational research, it puts the sub-discipline unduly under pressure to the extent that it possibly cannot survive. ABSTRACT:Stanley Cavell’s moral perfectionism places the task of cultivating richer self-understanding and self-expression at the center of corporate life. We show how his approach reframes business as an opportunity for moral soul-craft, achieved through the articulation of increasingly reflective inner life in organizational culture. Instead of norming constraints on business activity, perfectionism opens new possibilities for conducting commercial exchange as a form of conversation, leading to personal growth. This approach guides executives in designing businesses that foster genius and channel creativity, (...) while giving all stakeholders a meaningful voice within a culture of trust. We first give an account of Cavellian perfectionism. Then, we explain how this underrepresented strand of moral reflection challenges and enriches, but does not supplant, prevailing ethical theories—including other versions of perfectionism. We then demonstrate the salience of Cavellian perfectionism to business ethics through examples from marketing, human resources, and executive organizational design and development. (shrink)

I argue that we can find in Marx two objections to exploitation: an entitlement objection according to which it is wrongful because of the unjust distribution of benefits and burdens it generates; and an expressivist objection according to which it is objectionable because of the kind of social relation it is. The expressivist objection is predicated on a communitarian strand in Marx's thought, whereas the entitlement objection is grounded in a more liberal account of the wrongfulness of capitalist exploitation. (...) I conclude by connecting my analysis to the current debate between proponents and critics of market socialism. While market socialism could be a vehicle for realizing the values associated with the entitlement objection, this is not true for the expressivist objection. Furthermore, because the entitlement objection does not depend on a thick conception of the human good, it is in accord with the liberal ideal of political neutrality whereas the expressivist objection is not. This article is concerned with a central strand of Strawson's well-known and highly influential essay “Freedom and Resentment” Strawson's principal objectives in this work is to refute or discredit the views of the "Pessimist." The Pessimist, as Strawson understands him/ her, claims that the truth of the thesis of determinism would render the attitudes and practices associated with moral responsibility incoherent and unjustified. Given this, the Pessimist claims that if determinism is true, then we must abandon or suspend these (...) attitudes and practices altogether. Against the Pessimist Strawson argues that no reasoning of any sort could lead us to abandon or suspend our "reactive attitudes." That is to say, according to Strawson responsibility is a "given" of human life and society-something which we are inescapably committed to. In this article I argue that Strawson's reply to the Pessimist is seriously flawed. More specifically, I argue that Strawson fails to distinguish two very different forms or modes of naturalism and that he is constrained by the nature of his own objectives (i.e., the refutation of Pessimism) to embrace the stronger and far less plausible form of naturalism. On this basis I conclude that while there is something to be said for Strawson's general approach to these matters, we nevertheless cannot naturalize responsibility along the specific lines that he suggests. Recent work in the history of philosophy of science details the Kantianism of philosophers often thought opposed to one another, e.g., Hans Reichenbach, C.I. Lewis, Rudolf Carnap, and Thomas Kuhn. Historians of philosophy of science in the last two decades have been particularly interested in the Kantianism of Reichenbach, Carnap, and Kuhn, and more recently, of Lewis. While recent historical work focuses on recovering the threatened-to-be-forgotten Kantian themes of early twentieth-century philosophy of science, we should not elide the differences between (...) the Kantian strands running throughout this work. In this paper, I disentangle a few of these strands in the work of Reichenbach and Lewis focusing especially on their theories of relativized, constitutive a priori principles in empirical knowledge. In particular, I highlight three related differences between Reichenbach and Lewis concerning their motivations in analyzing scientific knowledge and scientific practice, their differing conceptions of constitutivity, and their relativization of constitutive a priori principles. In light of these differences, I argue Lewis’s Kantianism is more similar to Kuhn’s Kantianism than Reichenbach’s, and so might be of more contemporary relevance to social and practice-based approaches to the philosophy of science. This article motivates a shift in certain strands of the debate over legitimate roles for nonepistemic values in scientific practice from investigating what is involved in taking cognitive attitudes like acceptance toward an empirical hypothesis to looking at a social understanding of assertion, the act of communicating that hypothesis. I argue that speech act theory’s account of assertion as a type of doing makes salient legitimate roles nonepistemic values can play in scientific practice. The article also shows how speech act (...) theory might provide a framework for fruitfully extending aspects of the social and pragmatic turns in the philosophy of science. (shrink)

ABSTRACT This essay challenges the view that John Rawls's recently published undergraduate thesis A Brief Inquiry into the Meaning of Sin and Faith provides little help in understanding his mature work. Two crucial strands of Rawls's Theory of Justice are its critique of teleology and its claims about our moral nature and its expression. These strands are brought together in a set of arguments late in Theory which are important but have attracted little sustained attention. I argue that the target (...) of Rawls's undergraduate thesis is a form of Christianity which rests on assumptions Rawls later came to think were fundamental to teleological views, and that the thesis defends an alternative form of religiosity that anticipates what Rawls says in Theory about the expression of our nature. Those sections of Theory also provide resources Rawls could have used to respond to a number of prominent and recurrent criticisms of his account of moral motivation. Seeing the continuities between Brief Inquiry and Theory of Justice shows how long Rawls wrestled with problems he took up in the neglected sections of Theory and thereby shows their importance to Rawls's thought. Axiomatic and problematic approaches to ontology are discussed, at first in relation to the work of Badiou and Deleuze in mathematics. This discussion is then broadened focussing on problematics in Deleuze and Guattari’s critiques of capitalism and psychoanalysis which results in an analysis of the implications of this discussion for education. From this, education as being already there, which is an assumption in some strands of philosophy of education, following Deleuze’s critique of axiomatic presentations of ontological identities, is described as (...) a repressive, stabilizing operation, which produces objectives which are characterized as peculiar things. By contrast, those aspects of practice, knowledge, behaviours and populations which cannot be accommodated and resolved by axiomatic formulae and fall from axiomatic systems are characterized as queer things that constitute counter cultures. In her influential and challenging paper “Skepticism about Practical Reason” Christine Korsgaard sets out to refute an important strand of Humean scepticism as it concerns a Kantian understanding of practical reason.1 Korsgaard distinguishes two components of scepticism about practical reason. The first, which she refers to as content scepticism, argues that reason cannot of itself provide any “substantive guidance to choice and action” (SPR, 311). In its classical formulation, as stated by Hume, it is argued that reason cannot determine (...) our ends. Our ends are determined by our desires and reason is limited to the role of identifying the relevant means to these ends. The second component, which Korsgaard calls motivational scepticism, suggests doubt about the scope of reason as a motive. The claim here, as Korsgaard interprets Hume’s view on this matter, is that “all reasoning that has motivational influence must start from a passion, that being the only possible source of motivation” (SPR, 314).2 Korsgaard’s fundamental objective in “Skepticism about Practical Reason” is to show that motivational scepticism must always be based on content scepticism. In other words, according to Korsgaard, motivational scepticism has no independent force. In this paper I argue that Korsgaard’s attempt to discredit motivational scepticism is unsuccessful. It further encourages self-cultivation and effective government, recommending that rulers maintain self-discipline, hire reliable people, delegate power transparently, and promote others in an orderly fashion. The people, it is argued, will emulate their leader’s wisdom and virtue, and a just and peaceful state will result. Paul Fischer provides an extensive introduction and a chapter-by-chapter summary and analysis of the text—outlining the importance of syncretism in Chinese culture—and explores the text’s particular features, authorship, transmission, loss, and reconstruction over time. The Shizi set the stage for a long history of syncretic endeavor in China, and its study provides insight into the vital traditions of early Chinese philosophy. It is also a template for interpreting other well-known works, such as the Confucian Analects, the Daoist Laozi, the Mohist Mozi, and the Legalist Shang jun shu. (shrink)

In this paper, I explore Wittgenstein’s inheritance of one specific strand of Kant’s criticism, in the Critique of Pure Reason, of reason’s inherent pretensions to totality. This exploration reveals new critical possibilities in Wittgenstein’s own philosophical method, challenging existing interpretations of Wittgenstein’s political thought as “conservative” and exhibiting the closeness of its connection to another inheritor of Kant’s critique of totality, the Frankfurt school’s criticism of “identity thinking” and the reification of reason to which it leads. Additionally, it shows (...) how Wittgenstein’s linguistic philosophy offers to challenge and undermine, in a historically novel way, the metaphysical assumptions underlying some of our most characteristic and ubiquitous social practices. Robert Nozick has attempted to demonstrate that a state can emerge from anarchy which will be legitimate, in that it acquires power in morally permissible (i.e., non rights violating) ways. Its monopoly on force and apparent redistribution of holdings are, according to Nozick, justified by the steps required to prevent risky behavior by the dominant agency. These steps, I argue, contravene Nozick's own entitlement principles and so, his dominant agency is not warranted in taking them. This leaves Nozick "stranded" within (...) his own state of nature, the dominant agency unable to legitimately transform itself into a night watchman state. (shrink)

John Kinsella’s three-volume Graphology Poems: 1995–2015 constitutes a major and shifting set of poetic statements. Partly a discontinuous poetic chronicle of life in Western Australia’s Avon Valley, they are also an investigation of ways in which an activist poetry may inscribe aspects of being, self and experience while protesting against environmental challenges and degradation. As these poems sprawl in many directions and express overlapping preoccupations, and as they emphasise the unsettled and unstable while affirming what has a continuing importance, so (...) they constitute a series of ethical positions connected to living sustainably and responsibly. They also explore the porous nature of a poetic activism that steps out into the quotidian world while simultaneously refashioning the poetic, challenging and even subverting the language of the contemporary lyric and the contemporary pastoral. The Graphology poems prize incompleteness and the fragmentary, open out to reveal absences and imply other texts, value multiple meanings and represent many of the most important strands of Kinsella’s work. VAN STADEN'S PAPER, "Linguistic Markers of Recovery," takes on a formidable task. As he explains it, findings from a previously conducted empirical study suggest that recovery from a psychiatric condition can be predicted by certain (...) patterns of first person pronoun usage. His current paper explains how these patterns follow the mathematical logic of Gottlob Frege. van Staden's attempt to systematize the link between language and treatment outcome shows promise. We want to support his effort by raising a few caveats about the application of foundational systems in psychiatry and psychology, particularly the advisability of employing a logical system to explain recovery from mental illness. Along the way, we will be identifying related issues that the author may elect to take up in his future work.van Staden's proposal is inspired by Frege's logical system, but the paper is, at the very least, an innovative adaptation. There are various points where we are left to wonder just how much of this proposal is really Frege's. Nevertheless, the genesis of van Staden's ideas is so dependent that one would expect a fuller account of Frege's pivotal role in the development of modern logic, how his work precipitated what is known commonly as the linguistic turn, and why a logical system that was so well received when first articulated was eclipsed so quickly by Russell's Principia (1963) and Wittgenstein's Tractatus. (1981) These issues can be addressed separately and perhaps they should, because lacking an account of how Frege's philosophy developed and evolved makes the presentation appear somewhat sketchy and incomplete.Frege is portrayed in philosophical lore as the founder of modern logic and a pioneer of the movement that later became known as analytic philosophy. Dummett (1991) regards Frege's Foundations of Arithmetic (1968) as analytical philosophy's first work (p. 111). According to Quine (1955), "All modern logic owes an incalculable debt to Frege. If anyone can be singled out as the founder of mathematical logic, it is by all odds he" (p. 158). Rorty (1967) notes that analytic philosophy's tack of construing philosophical questions as turning on language use and construction challenges the entire tradition, from Parmenides forward. However, the challenge reaches fruition not in Frege, but in works of Moore, Wittgenstein, and Austin. In Part I it is argued that neither the humean nor the kantian answers to this question can be maintained simpliciter. Each side of the controversy has to make significant concessions to the other. One consequence of this is that humean and kantian approaches to action are less clearly distinguished than might initially be supposed. ;In Part II several central notions are examined. The idea (...) of a pre-rational motive is rejected, as is the view that desires can be divided into motivated and unmotivated. The assumption that reason in action always takes the form of deductive argument is also rejected. An alternative view is presented that reason in action is to be understood in terms of the process of questioning a person's motives. There is no specific point which must always mark the termination of such a process. The circumstances in which questioning takes place are at least as important as the form answers to questions take. ;This implies that both the humean and kantian accounts of morality are unacceptable as complete moral theories. Moral deadlock does not result solely from conflicts of wants or of understanding. Equally it is not explicable in terms of different cultures. Different ways we talk of virtue reveal both humean and kantian strands in our moral thinking. This article illustrates Sheila Dow's notion of ‘structured pluralism’ drawing on a recent empirical body of literature in which multiple research, or ‘Q-Squared’, approaches to causal analysis of poverty analysis have been used in the Global South. It maintains that understanding linguistic differences between schools of thought is quite integral to methodologically-aware critique and to improved methodological practice. The various strands in the Q2 literature together provide a case for methodological pluralism based on claims that knowledge is partial, empirical adjudication (...) is imperfect, the world is complex and combining multiple research approaches adds value. The goals of understanding and explanation are best served if research questions dictate choice of methodological approach rather than the other way around. (shrink)

The Envy of the Gods in Genesis 2 and 3 Paul DuffJoseph Hallman George Washington University University of St. Thomas According to Walter Brueggemann, "No text in Genesis (or likely in the entire Bible) has been more used, interpreted and misunderstood" than the story of Adam and Eve in the garden. "This applies to careless, popular theology as well as to the doctrine of (...) the church"(41). Augustine attempted to explain the first few chapters of Genesis on no fewer than five different occasions throughout his career. Based on his reading ofPaul, Augustine and Western Christianity after him believed that the entire human race inherited the disobedience ofAdam and Eve. The story in Genesis 2-3 represents the beginning ofthe J narrative, the so-called Yahwist account of the creation which originated in the early years ofthe Israelite monarchy.8 Commentators have long acknowledged a variety ofelements in the Yahwist creation account which complicate its interpretation and defy any satisfactory explanation. Among the more puzzling elements in the story are, first, the implication in Gen. 3:22 of a plurality of divine beings, a fact which seems to contradict the rest ofthe narrative and which also flies in the face of Israelite monotheism. God does not carry out the threatened punishment, however, nor does the text offer the reader an explanation for the deity's commutation ofthe sentence (Westermann 224-5). Third, the origin and nature ofthe serpent in the story is unclear. Where did he come from? The identification ofthis figure with Satan in the later tradition has no support in the text (Westermann 237-9). Finally, the prohibition not to eat ofthe single tree in the garden appears to be arbitrary. Hence the crime of Adam and Eve is obviously contrived. Despite the fact that the original sentence of death for their disobedience was not carried out, the curses invoked on Adam and Eve seem hardly warranted by the offense. Consequently, some sections ofthe text depict the deity as a petty tyrant, certainly a very different picture than that given by other scriptures ofthe Jewish and Christian traditions. We believe these difficulties can be overcome by approaching Genesis 2-3 from a Girardian perspective.9 We propose that this story has evolved10 in order to hide its original meaning. As a result—following Girard's understanding of the function and evolution of mythology—we will endeavor to "deconstruct" Genesis 2-3 in order to trace the evolution ofthis myth from its origin in a primal crime. This will enable us to explain the inconsistencies in the text as it stands and to appreciate the final revisions made by the biblical author(s). We will begin with a brief discussion of Girard's understanding ofmyth. Then we will turn to the problems ofthe Genesis text. Girard on myth According to Girard, myth is, quite simply, a narrative about a primal murder, rewritten from the vantage point ofthe killers (1977a, 64-7, 91-5; 1986, 24-44). As such, mythology covers up the role of the victimage mechanism as the basis ofculture. Myths which disguise or cover up such a crime can take many forms. Norman Daniels’s theory of health justice is the most comprehensive and systematic such theory we have. In one of the few articles published so far on Daniels’s new book, Just Health, Benjamin Sachs argues that Daniels’s core “principle of equality of opportunity does not do the work Daniels needs it to do.” Yet Sachs’s objections to Daniels’s framework are deeply flawed. Where these arguments do not rely on significant misreadings of Daniels, they ignore sensible strands in Just Health that considerably (...) dull their force. After disarming Sachs’s arguments against Daniels’s theory, I explain why I agree with Sachs’s conclusion: Daniels’s equality of opportunity-based account of health justice rests on shaky foundations. Loeb proposes a fresh account of the relation between the book's literary and philosophical aspects and argues that the book's narrative is designed to embody and exhibit the truth of eternal recurrence. Loeb shows how Nietzsche constructed a unified and complete plot in which the protagonist dies, experiences a deathbed revelation of his endlessly repeating life, and then returns to his identical life so as to recollect this revelation and (...) gain a power over time that advances him beyond the human. The theme that God suffers with his world has become a familiar one in recent years, but a careful examination is needed of what it means to talk about the suffering of God, avoiding the danger of a merely sentimental belief. This book offers a consistent way of thinking about a God who suffers supremely and yet is still the kind of God to whom the Christian tradition has witnessed, and also about a God who suffers universally and yet is (...) still present uniquely in the cross of Christ. It is at once both a survey of recent thought about the suffering of God and a proposal for a way forward in this important area of Christian theology. The author surveys four main trends of recent thought: the 'theology of the cross' in modern German theology ; American process theology; 'the death of God' theology; and finally, the rejection of the whole idea of divine passibility by modern followers of classical theism. He draws upon these schools of thought in the course of reflecting upon various aspects of the main theme of the study. This thematic structure enables an idea of divine suffering to be developed throughout the book, affirming that God freely chooses to limit himself, to suffer change, to journey through time and even to experience death while remaining the living God. The history of heterodox ideas about the concept of mind takes the reader from the earliest records about human nature in Ancient Egypt, the Ancient Near East, and the Zoroastrian religion, through the secret teachings in the Hermetic and Gnostic scriptures, and into the transformation of ideas about the mind, soul and spirit in the late antique and early medieval epochs. Liberal societies are built on a foundation of personal rights, including the right to make decisions about the medical treatment that one will receive or decline to receive. So essential to the liberal project is the power of individual choice that it will be abrogated only in the most extreme situations, in which persons seem to be unable to make rational decisions and thereby to protect their interests. A small number of decision-related abilities have been identified as relevant to the (...) determination of when a person will be deemed decisionally incapable: understanding, appreciation, reasoning, and choice. Voluntariness of consent to research has not been sufficiently explored through empirical research. The aims of this study were to develop a more comprehensive approach to assessing voluntariness and to generate preliminary data on the extent and correlates of limitations on voluntariness. We developed a questionnaire to evaluate subjects’ reported motivations and constraints on voluntariness. 88 subjects in five different areas of clinical research—substance abuse, cancer, HIV, interventional cardiology, and depression—were assessed. Subjects reported a variety of motivations for participation. Offers (...) of financial incentives were common but not influential, pressures from others were rare, and no threats were reported. However, certain financial incentives and—paradoxically—altruistic motivations led some subjects to feel more constrained. Consistent with previous studies, no one pattern of motivation was common to all research subjects. There was little evidence of constrained voluntariness, but some suggestion of areas of concern. Voluntariness appears to be susceptible to systematic empirical investigation. (shrink)

Recent Anglophone scholarship has successfully shown that Nietzsche's thought makes important contributions to a wide range of contemporary philosophical debates. In so doing, however, scholarship has lost sight of another important feature of Nietzsche's project, namely his desire to challenge the very conception of philosophy that has been used to assess his merits as a philosopher. In other words, contemporary scholarship has overlooked Nietzsche's contributions to metaphilosophy, i.e. debates around the nature, methods, and aims of philosophy. Appelbaum* (bio)AbstractThe preceding commentary by Louis Charland suggests that traditional cognitive views of decision-making competence err in not taking into account patients’ emotional capacities. Examined closely, however, Charland’s argument fails to escape the cognitive bias that he condemns. However, there may be stronger arguments for broadening the focus of competence assessment to include emotional capacities, centering (...) on the ways in which emotions aid humans in processing information. Before emotional capacities are added to the list of functions essential for decisional competence, though, the feasibility and utility of such a reorientation must be demonstrated.To what extent ought persons’ capacities to experience emotion be taken into account when determining whether they should be deemed competent to make their own decisions? In the previous article, Louis Charland (1998) argues that traditional models of decision-making competence—of which the MacArthur Competence Treatment Study is a typical example—are mistaken in focusing narrowly on persons’ cognitive abilities to the neglect of emotional factors. In contrast, he suggests, constructs of competence ought explicitly to require a capacity to experience emotions, which he believes is central to meaningful decision making, before deeming persons competent.Charland, as he acknowledges, is not the first to suggest that the presence of some degree of emotional capacity is a necessary element of competence, but his argument is among the most elaborate to date and is certainly worth closer examination. Looked at carefully, however, Charland’s argument does not make quite the case for the determination of emotional capacity in competence assessment that he claims for it. Indeed, as I demonstrate below, Charland may share the same “pernicious [End Page 377] cognitive bias” that he ascribes to more traditional approaches. However, despite what I identify as the problems in Charland’s argument, others have raised more disturbing questions about the lack of attention to emotional issues in competence assessment. Thus, I am not ready to reject entirely the possibility that determinations of decisional competence ought to consider emotional factors. I conclude by outlining the questions that remain to be answered to identify more clearly the potential benefits of such an approach.The Construct of Decision-Making CompetenceSome preliminary comments about the nature of the dominant construct of decision-making competence may provide a useful frame for my response to Charland’s paper. Contemporary ideas of competence are tied inextricably to the ideal of self-determination in modern Western societies. Such societies are committed to respect for individual choice, both as a good in its own right and on the grounds that each person knows best what choices will maximize his or her own welfare. In general, therefore, states will not intervene to prevent persons from acting on their decisions, even when the choices they make—like the decision to smoke or to refuse potentially life-saving medical care—may objectively be thought to be detrimental to them.In some cases, however, the presumption that people will act in their own interests, as well as the notion that there is something intrinsically valuable in respecting their choices, fails (Buchanan and Brock 1989). When people’s minds are so disordered that they cannot be said to be making meaningful choices, other values come into play. Such people are called “incompetent.” When persons reach that point, the state’s interest in protecting its citizens becomes primary and someone else must make decisions on their behalf. Note that the size of this group must be sharply limited, lest a liberal society’s commitment to self-determination be undermined: There is no more profound infringement of the rights of citizens than the determination that they are incompetent. Thus, the criteria for incompetence must be selected in a deliberately narrow fashion—alternately, one might say that the standards for competence are made intentionally broad—so that all but a tiny percentage of citizens will be permitted to make decisions on their own.In the Anglo-American world, the process of formulating criteria of competence by and large has been left to the common law courts.
